Agreement to Terms

By accessing or using GetLaunchDay (“the Service”), operated by GetLaunchDay Inc. (“we,” “us,” or “the Company”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users, including visitors, free-tier users, and paid subscribers.

Description of Service

GetLaunchDay provides a platform for startup idea validation, including landing page creation, waitlist management, email marketing, A/B testing, analytics, and AI-powered tools. Features vary by subscription plan.

Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• You must be at least 16 years old to use the Service.
• One person or entity may not maintain more than one free account.

Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights.
• Send unsolicited spam or bulk email through our email features.
• Create landing pages that are deceptive, fraudulent, or misleading.
• Distribute malware, phishing content, or any harmful software.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use the Service to collect personal data without proper consent.
• Resell access to the Service without our written authorization.
• Scrape, crawl, or use automated tools to extract data from the Service.
• Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice.

Subscription & Billing

Plans and pricing

The Service offers free and paid subscription plans. Current pricing is available at getlaunchday.com/pricing. We reserve the right to change pricing with 30 days' advance notice to affected subscribers.

Billing cycle

• Paid plans are billed monthly or annually, depending on your selection.
• Annual plans are billed as a single upfront payment for the full year.
• Billing begins on the date you subscribe and renews automatically.

Cancellation and refunds

• You may cancel your subscription at any time from your account settings.
• Cancellation takes effect at the end of your current billing period.
• We offer a 14-day money-back guarantee for first-time paid subscribers.
• After the 14-day window, no refunds are provided for partial billing periods.
• Annual plan cancellations: you retain access until the end of the annual term.

Failed payments

If a payment fails, we will attempt to charge your payment method up to 3 times over 10 days. If all attempts fail, your account will be downgraded to the free plan. Your data will be preserved for 30 days, after which content exceeding free-plan limits may be archived.

Intellectual Property

Your content

You retain full ownership of all content you create using the Service, including landing pages, email copy, images you upload, and data you collect. We claim no intellectual property rights over your content.

Our service

The Service, including its design, code, features, documentation, and branding, is owned by GetLaunchDay Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

AI-generated content

Content generated by our AI tools (copy, suggestions, recommendations) is provided to you for your use. You are responsible for reviewing and editing AI-generated content before publishing. We do not guarantee the accuracy, completeness, or legal compliance of AI-generated content.

Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

• You own the data you collect through the Service (e.g., waitlist signups, survey responses).
• You are responsible for complying with applicable data protection laws when collecting data from your users.
• You must provide a privacy policy on any landing page that collects personal information.
• We process your data in accordance with our Privacy Policy and applicable law.

Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by factors beyond our control, including internet outages, third-party service failures, or force majeure events.

Limitation of Liability

To the maximum extent permitted by law, GetLaunchDay Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities.
• Cost of procuring substitute services.
• Any damages arising from your use of or inability to use the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify and hold harmless GetLaunchDay Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Dispute Resolution

• These Terms are governed by the laws of the State of Delaware, United States.
• Any disputes shall first be attempted to be resolved through good-faith negotiation.
• If negotiation fails, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.
• Class action lawsuits and class-wide arbitrations are not permitted.
• Small claims court actions are exempt from the arbitration requirement.

Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Termination

We may terminate or suspend your access to the Service at any time for violation of these Terms, with or without notice. Upon termination:

• Your right to use the Service ceases immediately.
• We will provide a 30-day window to export your data upon request.
• Sections on Intellectual Property, Limitation of Liability, Indemnification, and Dispute Resolution survive termination.

Miscellaneous

• Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and GetLaunchDay.
• Severability: if any provision is found unenforceable, the remaining provisions continue in effect.
• Waiver: failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: you may not assign your rights under these Terms without our consent. We may assign our rights freely.
